California Lemon Law protects the rights of consumers who were sold defective vehicles. It provides a complete restitution or replacement of vehicles to owners of vehicles deemed to be defective. The manufacturer is also legally responsible for the attorney’s fees and costs incurred in litigating the case. A problem car’s owner can be entitled to a comparable replacement or a refund of the purchase price (prorated based on the miles driven). Under California lemon law, there are a few general qualifications:
- The car must still be under warranty.
- The owner must have taken the car in for repair for the same problem 4 times or more through an authorized dealer.
- The car must have been inoperable for a total of 30 days (not necessarily consecutive).
- The problem or defect must also substantially impair the use, value, or safety of the vehicle. To qualify, cars must be either purchased or leased in California for personal, family, or business use.
*Although these are the formal recognized qualifications to be considered when determining whether a vehicle can be declared as a lemon, these rules provide very broad guidelines, and there are countless exceptions to them. Not a single one of these rules has to apply to your car in order for it to qualify as a lemon. Even used cars can qualify under lemon law.
